Copyright Infringement: Universal Music Publishing Pty Ltd & Anor v Clive Palmer (NSD161/2019)

Politician/businessman Clive Palmer has been ordered to pay damages of AU$500,000 and additional damages AU$1 million for infringement of a musical work and literary work (lyrics) entitled “We’re Not Gonna Take It” by recording Palmer’s musical work “Aussies Not Gonna Cop It” and synchronising that work to associated videos used in his political campaign. Costs usually follow the result.

The Federal Court held that the Palmer work/recording and associated videos were without proper licence and a reproduction of a substantial part of the musical work and literary work “We’re Not Gonna Take It”.
